The lawsuit, which was previously dismissed by US District Judge Madeline Cox Arleo, gained new momentum as Antar filed an appeal that reached the US Third Circuit Court of Appeals this past Tuesday.

In the latest developments presented before a three-judge panel in Philadelphia, Antar’s attorney, Matthew Litt, argued that BetMGM engaged in aggressive and negligent behavior. Litt emphasized that BetMGM did not merely allow Antar to continue losing money passively; instead, they actively bombarded him with generous bonuses and enticing offers. Evidence presented included over 1,800 text messages sent to Antar in just six months starting from June 2019. These messages, Litt claimed, were a deliberate attempt to draw Antar deeper into the rabbit hole of gambling addiction, leading to an estimated $30 million in losses.
