As the gaming landscape continues to evolve, so do the legislative measures aimed at regulating it. Recently, the New York Senate Racing, Gaming, and Wagering Committee threw its support behind a groundbreaking bill, spearheaded by Senator Joseph Addabbo, to ban online sweepstakes gaming. The bill, known as S5935, targets the “dual-currency” systems often employed by online platforms, where users purchase virtual tokens that can later be converted back into real money or other rewards. Such mechanisms often mimic traditional casino games but operate outside the rigorous regulatory frameworks that conventional gambling businesses must adhere to.

The proposed legislation doesn’t merely halt these gaming sites; it also imposes sanctions on financial institutions, payment processors, and service providers that facilitate these operations. Penalties for non-compliance are steep, ranging from fines of $10,000 to $100,000 per offense, and could even extend to the revocation of gaming licenses. Agencies such as the New York State Gaming Commission, the Attorney General’s office, and local law enforcement would be responsible for enforcing these new laws. Senator Addabbo emphasized the significant risks these platforms pose to younger audiences, who can easily access them via smartphones and computers. The lack of regulatory oversight, he argues, not only endangers users but also threatens the integrity of the state’s regulated gambling industry.
